GENERAL CONDITIONS OF SALE AND RIGHT OF WITHDRAWAL

Brums Milano Srl provides the following information relating to the conditions of sale and withdrawal.

 

  1. OBJECT

The General Terms of Sale concern the sale of products made through the electronic commerce service on the website www.brumsmilano.com (hereinafter "Product/s").

In consideration of the large number of products made available, the main characteristics and prices of the same (including any additional cost) are indicated directly on the site.

The products offered through the website are currently only available in Italy.

All product orders are subject to product availability. Any unavailability of the products ordered is communicated within 30 (thirty) days from the day following the day on which the order was sent; we reserve the right to provide you with all the information relating to substitute products of equal or greater quality and value than the products ordered and which you may decide to request. In case of forwarding the order form and advance payment of the total due, and in the event that you do not want to place an order for replacement products, we will refund you for the entire amount already paid according to the timing and rules specified in the right section of withdrawal (indicated in point 8 of this regulation).

The seller of the Products (hereinafter "Seller") is Brums Milano Srl, with registered office in via Freguglia n. 8/a, 20122 Milan (MI), Telephone Operational Headquarters 0331 988111, e-mail info@brumsmilano.com, PEC brumsmilanosrl@legalmail.it , registration number in the Milan Company Register (REA) no. 2650618, VAT and Fiscal Code: 12273870969.

The Customer using the Site and placing orders will be identified through the data entered by the same.

It is forbidden to provide false and/or invented data and to place false or fraudulent orders.

By placing an order through the Site, you warrant that you are over 18 years of age and have the legal capacity to enter into binding contracts.

  1. METHOD OF PERFORMING THE CONTRACT AND ORDER CANCELLATION

In order to conclude the sales contract for one or more products on the website, the order form must be completed in electronic format and sent to Brums Milano Srl electronically, following the instructions and procedure indicated on the website.

The order form contains a summary of the General Conditions of Sale and the main data of your order such as:

  • summary of the product purchased bearing the name of the article;
  • SKU product number;
  • size;
  • quantity purchased;
  • subtotal;
  • taxes included (VAT);
  • shipping information and costs;
  • summary of the chosen payment and shipping method;
  • total amount of the order.

The contract is finalized when Brums Milano Srl receives your order form electronically and, once the correctness of the data relating to the order has been verified, sends you the order confirmation via e-mail.

We inform you that before proceeding with the purchase of the products, you will be asked to accept the General Conditions of Sale set out here and for this reason we advise you to print, save or keep these Conditions.

The order form will be filed in our database for the period of time necessary to process the order and in any case in accordance with the law.

In case of purchase as a registered user and not as a guest, you will be able to access your order form by consulting the "My Orders" section. Once the purchase process has been completed, Brums Milano Srl will take charge of your order and receive all communications relating to the shipment of the purchased products.

In the event of false, fraudulent orders or orders from countries not included among those authorized, in the event that they do not give sufficient guarantees of solvency or are incomplete or incorrect, it is not possible to process your orders. In such cases we will inform you, by e-mail, that the sales contract has not been concluded and that we will not process your order, specifying the reasons.

We reserve the right as of now to remove any product from the website at any time and/or delete or modify any material or content thereof. Exceptional circumstances may arise which oblige us to refuse to place an order even after sending the Order Confirmation.

  1. SALE PRICES

The prices of the Products (hereinafter the "Price/s") and the shipping costs (hereinafter the "Shipping Costs") are those indicated on the Site and at the time the Order Proposal is sent.

Prices and Shipping Costs are to be considered inclusive of taxes and duties. In the event of exercising the right of withdrawal, the Shipping Costs that have already been paid by the Customer are excluded from the refund.

Although unlikely, it is not impossible that for some of the Products on the Site a price other than the actual one is indicated by mistake. It will be the Seller's responsibility to verify the correctness of the Prices before sending the Order and Shipping Confirmation. If, due to technical errors, material errors or other inconveniences, the Price indicated on the Site should be lower than the correct selling price of the Product, the Customer will be contacted to check whether he still wishes to purchase the Product at the correct price. If you do not wish to proceed with the purchase, the Order Proposal will be cancelled. If the price indicated on the Site is higher than the correct selling price of the Product, the Order will be processed by charging only the lower price.

  1. TERMS OF PAYMENT

Once the purchases have been made, the items will be added to the cart and subsequently there will be the completion of the order and payment.

Payment of the price and related shipping costs can be made in one of the ways listed on the order form.

The aforementioned methods are:

  • Credit card
  • PayPal
  • Apple Pay
  • Google Pay
  • ShopPay

In case of payment by credit card, the financial information (for example, the credit/debit card number or its expiry date) will be forwarded via encrypted protocol to a remote electronic payment service provider, without third parties may, in any way, have access to it. This information will not be used except to complete the procedures relating to your purchase and to issue the relative refunds in the event of any returns of the products, in the event of unavailability of the products themselves, or if it is necessary to prevent or report to the police the fraud commission.

The price for the purchase of the products and the shipping costs, as indicated in the order form, will be charged to you according to the times and payment methods chosen by you.

The prices of the products indicated on the website are inclusive of VAT.

  1. SHIPPING AND DELIVERY

The delivery of the Products can take place in the following ways:

- delivery to the address indicated by the Customer;

The delivery of the ordered products takes place within thirty (30) days from the date of transmission of the order. In case of choice of delivery to the address indicated by the Customer, it is possible to follow the shipment of the order using the Online Tracking number provided by the Courier. As soon as the Courier takes charge of your order, you will receive a shipment confirmation e-mail which will indicate the tracking number of your order. Shipments will be processed using the BARTOLINI courier. The aforementioned courier delivers from Monday to Friday during office hours and it will not be possible to arrange deliveries by appointment. In the event of non-fulfilment, for any reason, of the terms indicated above, we will promptly inform you and we will give you the possibility of setting a new delivery date or the possibility of canceling the order with consequent refund of the entire amount paid.

If you are not present at the time of delivery, at the established time, please contact us in order to arrange delivery at a later date.

Each delivery is considered to have taken place where a signature has been affixed to the collection at the agreed shipping address.

  1. RIGHT OF WITHDRAWAL

The Customer will have the right to withdraw from the contract concluded on the Site, without any penalty and without specifying the reason, by returning all or part of the Products purchased to the Seller.

The Customer must notify the Seller of his/her intention to exercise the right of withdrawal within 14 working days from the day on which he/she received the products purchased on brumsmilano.com. The products to be returned must be delivered to the courier within 14 working days from the date of their receipt. The courier will pick up the return directly at your residential and/or domicile address free of charge.

However, it will not be possible to replace the chosen garment with another garment, whether of the same model or of different models.

The right of withdrawal is subject to the following conditions:

  • the return of the products must take place within 14 (fourteen) working days from the delivery date
  • the products must not have been used, worn, washed or damaged
  • the identification tag must be returned intact and applied to the products
  • products must be returned in their original packaging
  • returned products must be delivered to the courier within 14 working days from the date on which he received the products

If all the required conditions are met, you will be refunded, within 14 days of receiving the returned items, the full price of the products purchased, excluding shipping costs incurred at the time of purchase. The shipping costs for the return are entirely borne by Brums Milano Srl.

In the event that your return cannot be accepted because it does not comply with the aforementioned conditions, you will be contacted by Customer Service and you can choose to get the purchased products back at their expense. In case of refusal, Brums Milano Srl reserves the right to withhold the products and the amount corresponding to them.

    Procedure for making a return:

    • Go to the "Make a Return" page
    • Enter your order number, fill in the required fields and send your return request.

    You will receive notifications via e-mail with updates on the status of the return and you will need to indicate the date for collection by the courier.

    We remind you that an entered return request cannot be modified.

    Refund times and methods:

    The refund, according to the payment methods chosen at the time of the order, will be issued by Brums Milano Srl once the returned items have been delivered to the warehouse and the integrity of the items and tags has been verified.

    Regardless of the payment method used to purchase the returned items, the refund will be made within 14 working days from the date on which Brums Milano Srl became aware of the exercise of your right of withdrawal, after verifying that the withdrawal took place in compliance with the above conditions.

    The effective time for re-crediting or returning the sums paid for the purchase of the products depends on the payment methods used:

    • payment made by credit/debit card: the actual crediting date depends on the institution that issued the credit/debit card. The value date of the re-credit will in any case be the same as the debit, therefore you will not suffer any loss in terms of bank interest;
    • payment by loyalty voucher or gift card: the refund takes place through the issue of a voucher that can be spent exclusively online.

    In the event of a gift, the refund of the sums will be made to the person who made the payment.

    1. LIABILITY FOR DAMAGE FROM DEFECTIVE PRODUCTS AND LEGAL WARRANTY FOR NON-CONFORMING PRODUCTS

    Upon delivery, the Customer must check the Products in order to ascertain that they correspond to the items ordered and that they do not present any lack of conformity. The legal guarantees established by current legislation, articles 129 and following of the Consumer Code relating to the legal guarantee of conformity of the goods, are applicable to the sale of the Products.

    The risks relating to the products ordered will pass to the Customer from their delivery.

    You will acquire ownership of the products ordered as soon as we have received the total amount relating to them, including any shipping costs.

    In the event of a package containing fewer items than those paid for in your order and shown on the delivery note, we invite you to report it no later than 5 days to our customer service by email customerservice@brumsmilano.com .

    The essential characteristics of the products are indicated on the website within each product sheet. In particular, each product sheet indicates:

    • product name
    • product code
    • price
    • description
    • product photos

    Product prices may be subject to updates and/or changes, for this reason we ask you to ascertain the final sale price before submitting your order form.

    In the event that we should find errors in the price of the products you ordered, we will promptly inform you and we will give you the option of re-confirming your order with an indication of the correct amount or canceling it; in the event that we are unable to contact you, the order will be canceled and you will be refunded for the full amount paid.

    We inform you from now on that we will not have the obligation to supply you with the product or products at the lower price indicated by mistake if the aforesaid error was obvious and unequivocal and therefore if it was possible for you to identify it as wrong in a reasonable way.

    The products are provided with an identification tag which shows the barcode, the price and the size. It is advisable not to remove the tag before having verified the correctness of the size purchased.

    In the event that you exercise your right of withdrawal, the return of products without the relative tag or altered in their essential and/or qualitative characteristics or which have been used and/or damaged in some way is not accepted.

    In the case, communication will be given in various ways (for example, publication on sites, newsletters, with a banner, a pop-up or a push notification) or by forwarding a specific e-mail if the change affects the purposes for which the data has been collected, in such a way that changes can be viewed, the appropriate assessments made and, if necessary, opposed or canceled any services or functions.

    The new versions of the Terms of Sale will be effective from the date of publication of the same on the Site and in relation to Orders submitted after that date.
